Court Jails 38 yr Old Kitwe Guard To 45yrs For Defiling & Impregnating 14-year-old Girl

THE Kitwe High Court has sentenced a 38-year old security guard to 45 years imprisonment with hard labour for defiling and impregnating a 14-year old girl.
Kitwe High Court Judge Judy Mulongoti said the fact that the man in question impregnated the girl was a serious aggravating circumstance.
This is in a case where Samson Mbuzu, a security guard at Antelope Milling and resident of house number 2808, Racecourse in Kitwe was facing one count of defilement.
It is alleged that on an unknown date but between March 1 and August 13 this year, Mbuzu had unlawful carnal knowledge of a girl under the age of 16.
Mbuzu was tried and convicted of the subject offence by the Kitwe Magistrate’s Court.
During trial, the court heard that Mbuzu sneaked into the girl’s bedroom without her permission and forced himself on her.
The girl’s mother also testified that she discovered that her daughter was pregnant and when she questioned the girl, she disclosed that Mbuzu was responsible.
In defence, Mbuzu said he had sex with the girl because she told him that she was 17 years old.
He said the girl appeared to be big and consented to the sexual act.
In mitigation through Legal Aid counsel Sekelabaka Kundachola, Mbuzu asked the court for maximum leniency as he was responsible for supporting his aged parents.
Mrs Kundachola further urged the court to be lenient with her client on the basis that he was a first offender who was remorseful for his actions.
But Mrs Justice Mulongoti said although she had heard what had been said in mitigation, it was disheartening that defilement cases kept on increasing unabated.
“You chose to defile a young child aged 14 and she
ended up becoming pregnant.
I consider this to be a serious aggravating circumstance,” Justice Mulongoti said.
She said Mbuzu’s 45-year jail term is with effect from his date of arrest.
