Lusaka Magistrate David Simusamba has reserved ruling to Thursday this week in a case were incarcerated MMD faction leader Nevers Mumba has applied for bail pending appeal.
This is in a matter were Dr. Mumba was jailed for three months simple imprisonment for giving false information to a public officer.
When the matter came up, Dr. Mumba applied for bail saying if not granted he might serve a substantial part of the sentence before his appeal is heard.
But the state objected saying the convict has failed to show special circumstances as to why he should be given bail.
After listening to both parties Lusaka Magistrate David Simusamba informed the court that he will deliver a ruling on the matter on Thursday.
This means that Dr. Mumba will remain in jail as he waits for Magistrate Simusamba to pronounce himself on the bail application.
Meanwhile Magistrate Simusamba has granted permission to Dr. Mumba to appeal against the lower courts judgement in the High Court.
Last week Dr. Mumba was acquitted on one count of trespass and convicted on one count of giving false information to a public officer.
